This case traces back to 2014, when the nurse, employed at a Nicosia hospital, admitted to not sterilising the instruments, citing a lapse in her duties. The gravity of this oversight led her employer to terminate her employment.

In the wake of her dismissal, the nurse sought justice through a labour disputes court, asserting that her firing was unlawful due to a lack of a proper hearing. She also pursued compensation for what she claimed was an illegal termination of her contract.

However, the labour disputes court found her arguments unconvincing, ruling that the dismissal was justified given the circumstances. Seeking to overturn this decision, the nurse then escalated the matter to the appeals court.

In its recent ruling, the appeals court affirmed the earlier decision, stating that the nurse’s actions could have posed a significant risk to patient safety and health. Notably, the court highlighted that the nurse did not contest the facts surrounding the case, which solidified the legitimacy of her employer’s decision.

Addressing the severity of the sacking, the appeals court acknowledged that while the decision might seem harsh, it was not disproportionate to the error committed by the nurse. This ruling reinforces the critical importance of adherence to safety protocols within medical settings, particularly regarding patient care.
