A former police officer has requested the Attorney-General (AG) to suspend the prosecution related to the death of National Guard soldier Thanasis Nicolaou, citing an “abuse of process.” This plea comes two decades after the soldier’s body was discovered under the Alassa bridge, a case shrouded in controversy and claims of a cover-up.
Thanasis nicolaou: Contested Findings from 2005
Thanasis Nicolaou, aged 26 at the time of his death, was initially ruled to have committed suicide. However, his family has long disputed this conclusion, asserting that their loved one was murdered. The case has garnered public attention, with many calling for a thorough investigation into the circumstances surrounding his death.
Christakis Kapiliotis’ Legal Maneuver
The individual seeking to suspend the proceedings is Christakis Kapiliotis, who served as the head of Lania Police Station when Nicolaou died in September 2005. Through his lawyer, Andriana Klaedes, Kapiliotis has argued that the time elapsed since the incident makes it inappropriate for private criminal prosecutions to continue. His request strategically references a previous assessment from the AG’s office regarding the evidence in the case.
Assistant AG’s Assessment
Kapiliotis’ letter includes a response from Assistant AG Savvas Angelides, dated 11 June 2025. In this correspondence, Angelides dismissed a request from the Nicolaou family’s lawyer, Nikos Clerides, to initiate state prosecutions based on the Pappas-Athanasiou report. He stated that there was “insufficient evidence” to support allegations of deliberate neglect of duty.
Responses from Co-defendants Expected
In addition to Kapiliotis, four other defendants are involved in the private prosecution, including medical examiner Panikos Stavrianos, former Limassol Police Director Andreas Iatropoulos, former Limassol CID head Nicos Sophocleous, and former Rural Police head Christakis Nathanael. These individuals are anticipated to submit similar requests to the AG concerning the prosecution.
Next Steps for the Nicolaou Family
The AG has requested that the Nicolaou family lawyers respond to Kapiliotis’ suspension request within 15 days. The family is reportedly poised to oppose the request, advocating for the continuation of the prosecution to reach a conclusive court decision. This follows previous declarations from the AG indicating that he would not halt private prosecutions should the family wish to proceed.
Upcoming Court Proceedings
The defendants made their initial court appearance on Tuesday, 9 December, during which a preliminary objection regarding a conflict of interest was raised. The court has scheduled the next hearing for 22 January 2026, as the legal battle surrounding this contentious case continues to unfold.
