The Law Office has announced its decision not to pursue criminal prosecution against Nikos Sykas, a former DISY MP, in connection with a domestic violence case, citing insufficient evidence without the complainant’s testimony.
The controversy began when Sykas’s partner alleged he assaulted her during a New Year’s Day holiday in Athens. Following their return to Cyprus, she filed a complaint with Limassol police but later withdrew it through a sworn statement. Despite her retraction, police continued their investigation, highlighting their obligations under domestic violence legislation.
The investigation included various forms of evidence such as witness statements, photographic documentation, medical certificates, and forensic reports. Allegations against Sykas included physical and psychological violence, as well as assault causing actual bodily harm. Throughout the process, Sykas consistently denied the claims.
In a significant ruling, the supreme court unanimously lifted Sykas’s parliamentary immunity, determining that the alleged offences were serious and unrelated to his duties as a politician. As a result, DISY removed him from its ballot for the upcoming parliamentary elections on 24 May 2026, reinforcing a strong stance against violence towards women. Sykas has since challenged this decision in court, asserting that the party acted prematurely and denied him the opportunity to present his case.
The Law Office stated that the investigation was approached with the seriousness it warranted, emphasising that inquiries into violence against women should not solely rely on the cooperation of the complainant. Following a thorough evaluation of all available evidence, the Law Office concluded that the absence of the complainant’s testimony, which they regarded as essential for court proceedings, meant there was insufficient material to initiate a criminal prosecution. They reiterated the importance of the presumption of innocence throughout the investigation.
The case will remain open for one year, with the state affirming its commitment to provide necessary support and protection to the complainant. The Law Office has indicated that no further information will be disclosed regarding the content of the evidence or specific details of the case, citing the privacy of the individuals involved and the integrity of any potential future proceedings.
